Terms and Conditions.

These Terms and Conditions govern your use of 33-games.com and any orders you place with 33 Games. By placing an order you agree to these terms. Please read them carefully and save a copy for your records.

References to “we”, “us” or “our” mean the entity above. References to “you” or “your” mean the customer placing an order.

2. The contract between us

Your order is an offer to buy the goods you have selected. We accept your offer when we send you an email confirming dispatch of the goods. Until that point no contract is formed and we may decline your order — for example if the item is out of stock, if a pricing error has occurred, or if we are unable to obtain payment authorisation.

If we decline your order we will refund any payment taken in full.

3. Products

33 Games produces physical collectors’ editions, vinyl records, trading cards, books and related merchandise. Product images, descriptions, colours and specifications are intended as a fair representation. Small variations are part of the handmade and limited-edition nature of these products and are not defects.

Stock is limited. Some editions are produced in strictly numbered runs and we will not be able to obtain additional stock once sold out.

4. Price and payment

  • Prices are shown in pounds sterling (GBP). 33 Games Ltd is not VAT-registered, so no VAT is charged on orders.
  • Delivery is charged separately and shown at checkout before you confirm the order.
  • We accept the payment methods shown at checkout, including major debit and credit cards, Apple Pay, Google Pay, and Klarna (Pay in 3) for eligible orders. Payment is taken in full at the point of order.
  • If a product is mispriced and the error is obvious, we will contact you before processing the order. You may choose to proceed at the correct price or cancel.

5. Delivery

Estimated delivery times are shown at checkout. We aim to dispatch in-stock items within 3 working days of order. Pre-orders and reservation items are dispatched as soon as the relevant production run is complete; the release window is shown on the product page.

Risk passes to you on delivery. Ownership of the goods passes to you once we have received full payment and the goods have been delivered.

For international orders, you are responsible for any import duties, taxes or customs fees charged in the destination country.

6. Your right to cancel — consumer returns

If you are a consumer (i.e. not buying for a business), you have a statutory right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. 7. Faulty or damaged goods

You have legal rights under the Consumer Rights Act 2015 if the goods you receive are faulty, mis-described, or not of satisfactory quality. Nothing in these terms affects those rights.

If your order arrives damaged or faulty, please email info@33-games.com within 30 days with your order number and photos of the issue. We will arrange a replacement, repair or refund as appropriate.

8. Promotional codes and discounts

  • Promotional codes are valid only during the period stated and cannot be combined unless we say otherwise.
  • We may withdraw or change a promotion at any time before it is applied to an order.
  • Codes have no cash value and cannot be exchanged.

9. Limitation of liability

Nothing in these terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • any liability that cannot lawfully be excluded under English law (including under the Consumer Rights Act 2015).

Subject to the paragraph above, our total liability to you for any single order is limited to the price you paid for that order. We are not liable for any business losses, loss of profits, or indirect or consequential loss.

10. Events outside our control

We are not liable for any failure or delay in performing our obligations under these terms that is caused by events outside our reasonable control (for example postal disruption, supplier failures, fire, flood, war, civil unrest, pandemic, or government action). If the event continues for more than 30 days you or we may cancel the order and we will refund any payments taken for undelivered goods.

Our handling of your personal data is described in our Privacy Policy.

12. Changes to these terms

We may change these terms from time to time. The terms that apply to your order are the version published on this page when your order is accepted. The “Last updated” date at the top shows when the current version came into force.

13. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales have non-exclusive jurisdiction.

If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
